Family of Nancy Benoit Return to Court for Nude Pictures Case

NANCY Benoit’s family have returned to court for an appeal hearing on their lawsuit against Hustler Magazine. After the death of Nancy Benoit, Hustler magazine published nude photos of her that were shot in 1983. Nancy’s family sued Hustler magazine as a result.

Nancy Benoit was the wife of Chris Benoit, who was tragically murdered by Chris Benoit in 2007. After Hustler published the photos, a jury at trial ruled in June 2011 that Hustler must pay nearly $20 million in damages to the family. That amount was reduced by a federal judge who capped the payout at $250,000 in line with Georgia law.

The family of Nancy appealed against the reduction on Wednesday, January 25 to allow the original payout stand. Hustler argue that the photos are ‘newsworthy’, due to Nancy’s semi-celebrity status.
